Secured Creditor Representation

A major facet of Snow Spence Green LLP's practice is secured creditor representation, particularly with respect to holders of statutory mineral liens or M&M liens. Often times in oil and gas bankruptcy cases, the debtor will have granted mortgages to lenders purporting to encumber substantially all of the debtor's assets. Early recognition and assessment of the rights available to holders of statutory mineral liens under applicable state law is often a key to recovery in such bankruptcy cases.

The Firm has significant experience in the filing and perfection of statutory mineral liens under the various laws enacted by oil and gas producing states to protect suppliers of oilfield material, machinery, supplies, labor, and services. The Firm is equally well versed in the steps needed to maximize such lien rights in the bankruptcy context. Often, holders of statutory mineral liens can maximize their rights in bankruptcy, while minimizing their individual litigation costs by collective representation. The Firm often represents similarly situated mineral lien holders in bankruptcy proceedings. In addition, the Firm has been successful in prosecuting contested matters and adversary proceedings that affect the rights of holders of statutory mineral liens in bankruptcy proceedings, including prosecuting objections to cash collateral and post-petition financing motions (which often times seek to subordinate or limit the rights of mineral lien holders), 363 asset sales, classification of secured claims and other disclosure statement issues, plan confirmation, and lien priority litigation.
